Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Luteal Health ("we," "us," "our," or "Company"). By accessing our website, creating an account, using our services, or engaging with our healthcare providers, you agree to be bound by these Terms.
If you do not agree to all of these Terms, you may not use our services. We reserve the right to modify these Terms at any time. Your continued use of our services following the posting of revised Terms means that you accept and agree to the changes.
1. Description of Services
Luteal Health is a telehealth nurse practitioner practice specializing in comprehensive endometriosis care. Our services include:
- Virtual consultations with licensed Nurse Practitioners
- Initial assessments and ongoing management
- Treatment planning and prescription management
- Educational resources and care coordination
Important Medical Disclaimer
Our services are not a substitute for emergency care. If you are experiencing a medical emergency, including severe abdominal pain, chest pain, difficulty breathing, or other life-threatening symptoms, please call 911 or visit your nearest emergency room immediately.
Luteal Health services do not replace comprehensive in-person medical care. While we provide specialized telehealth services for endometriosis management, patients may need additional in-person evaluations, imaging, or specialist referrals based on their clinical needs.
2. Eligibility Requirements
To use Luteal Health services, you must:
- Be at least 18 years old
- Be a resident of California, Texas, or Florida
- Have a valid form of identification
- Have valid insurance or be able to pay out-of-pocket fees
- Have a reliable internet connection for telehealth consultations
- Agree to provide accurate health information
We reserve the right to refuse or terminate services to anyone who does not meet these requirements or who violates these Terms.
3. User Responsibilities and Obligations
As a user of Luteal Health services, you agree to:
- Provide accurate information: All health history, symptoms, and personal information must be truthful and complete
- Maintain confidentiality: Keep your login credentials secure and do not share access with others
- Honor appointments: Notify us at least 24 hours in advance if you need to cancel or reschedule
- Follow medical advice: Engage in good faith with treatment recommendations and follow-up care
- Report changes: Notify your provider of new symptoms, medication changes, or health developments
- Use services lawfully: Do not use our platform for illegal purposes or to transmit harmful content
- Respect intellectual property: Do not copy, distribute, or modify our content without permission
- Maintain appropriate conduct: Treat our staff with respect and maintain professional communication
Failure to comply with these obligations may result in termination of your account and cessation of services.
4. Intellectual Property Rights
All content on the Luteal Health website and platform, including text, graphics, logos, images, videos, and software, is the property of Luteal Health or its content suppliers and is protected by international copyright laws.
You are granted a limited, non-exclusive license to access and view this content for personal, non-commercial use. You may not:
- Reproduce, modify, or create derivative works from our content
- Distribute, sell, or license our content
- Remove or alter any copyright, trademark, or other proprietary notices
- Frame or embed our content on other websites without permission
Educational materials provided by Luteal Health are for your personal health management only and may not be shared publicly without written permission.
5. Payment Terms
Payment for Luteal Health services is due according to the pricing structure agreed upon at the time of booking:
- Initial assessments: $149 (non-refundable once consultation begins)
- Ongoing care: Pricing varies based on service package selected
- Insurance: We will bill your insurance when available; you are responsible for any co-pays, co-insurance, or deductibles
All prices are in USD. Payment is required at the time of service unless prior arrangements have been made. We accept major credit cards and may offer payment plans for qualifying patients.
6. Cancellation and Refund Policy
Cancellations: If you need to cancel an appointment, please notify us at least 24 hours in advance. Late cancellations or no-shows may result in a cancellation fee.
Refunds: Once a consultation has begun, fees are non-refundable. If you cancel more than 24 hours before your appointment, you may reschedule at no charge.
For services paid through insurance, refund policies are subject to your insurance plan's terms and conditions.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUTEAL HEALTH AND ITS PROVIDERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Outcomes resulting from your failure to follow medical advice
- Decisions made by other healthcare providers or facilities
- Complications from underlying medical conditions
Our total liability under these Terms shall not exceed the amount you have paid for services in the past 12 months. This limitation applies even if we have been advised of the possibility of such damages.
8. Disclaimer of Warranties
Luteal Health services are provided "as is" and "as available" without warranty of any kind. We do not warrant that:
- Services will meet all of your health needs or expectations
- Services will be uninterrupted or error-free
- Any defects will be corrected
- Results will be guaranteed or specific outcomes will occur
Your use of our services is at your own risk. You assume full responsibility for determining whether our services are appropriate for your health situation.
9. Indemnification
You agree to indemnify, defend, and hold harmless Luteal Health, its owners, employees, and providers from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of our services in violation of these Terms
- Your violation of any applicable laws or regulations
- Your infringement of any intellectual property rights
- Your failure to disclose relevant health information
- Your breach of any obligations under these Terms
10. Termination of Services
Luteal Health reserves the right to suspend or terminate your account and services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:
- Violation of these Terms
- Provision of false or misleading health information
- Abusive or threatening behavior toward staff
- Failure to pay fees
- Ineligibility based on location or other requirements
Upon termination, your access to the platform will be revoked, and you will lose any remaining credits or services. Medical records will be maintained in accordance with applicable laws.
11. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of Luteal Health services shall be brought exclusively in the state or federal courts located in California. You consent to the personal jurisdiction and venue of such courts.
12. Dispute Resolution
Before pursuing any legal action, you agree to attempt to resolve disputes through good faith negotiation with Luteal Health.
If a dispute cannot be resolved through negotiation within 30 days, either party may pursue available legal remedies. In the event of any legal proceedings, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
13. Modifications to Terms
Luteal Health reserves the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the revised Terms on our website and updating the "Last updated" date.
Your continued use of Luteal Health services following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be reformed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Luteal Health regarding your use of our services. These Terms supersede all prior negotiations, representations, and agreements, whether written or oral.
